IRU welcomes Posting of Workers derogation plan
[ October 31, 2017 // Chris ]The International Road Transport Union (IRU) welcomed a European Commission proposal for a lex specialis (similar to a derogation) to the Posting of Workers Directive. It would introduce specific rules for the road transport sector, taking into account the highly mobile character of such operations.
In an open letter to transport attaches, Members of the European Parliament and key individuals in the European Commission on 27 October, it also welcomed the agreement by the Employment, Social Policy, Health and Consumer Affairs Council on 23 October to keep open the decision on posting rules for road transport in the on-going negotiations on the EU Mobility Package. However, IRU is greatly concerned about the decision to continue to apply the general Posting of Workers Directive to the transport sector until specific rules have been agreed. Implementation in an increasing number of member states across the EU has demonstrated that the rules are a heavy administrative burden for transport operators. Member states have moreover not provided sufficient information on how transport operators should apply the rules to their drivers for the time spent abroad – issues need to be urgently addressed.
